In the 42nd amendment of the Constitution 1976 vide Article – 48 A and Art 51 (g) having direct link with the environment is as follows:

Act 48A:

The state shall endeavor to protect and to improve the environment and to safeguard the forests and wild life of the country.

Art 51 – A (g):

It is the duty of every citizen to protect and improve the natural environment including forests, lakes, rivers, and wild life to have sympathy towards all living creatures.

Article 21:

Article 21 of the constitution guarantees fundamental rights to life and personal liberty to all persons in India and is enforceable in the court of law.

A large number of activities which damage the environment including lack of underground drainage, encroachment of public parks, mining quarries etc. have been interpreted by the Supreme Court (Article-21). The measures are taken like levying fines against noise pollution.

Article 39A in the constitution to provide ‘equal Justice and legal aid’.
